In 2017, her husband had a junior four, and the junior three committed suicide after looking for her husband. The wife witnessed the whole process.

A woman is willing to be someone else's mistress for love, and even wants to replace the original match. She has been waiting for a man to divorce his wife and marry her.

But the man found another junior four and abandoned her.

She couldn't bear such a blow, so she stabbed a man with a knife and then stabbed herself to death. And the man's wife is watching it happen.

It sounds like the plot of a TV series, but it really happened.

This happened on February 20, 2017 in a garment factory in Xiangcheng District, Suzhou.

At that time, there were three people at the scene: the man Li, his wife Xie and his little mistress Liang. The feud between them eventually led to Liang's tragedy.

Then, in this case, who should be protected and compensated by law?

  A nondescript love affair

Both Liang and Li are garment factory owners, who have opened their own factories in Zhejiang Province.

They met in 2014 and started a love affair.

At that time, Li had been married for many years and had three children.

He and his wife, Xie Mou, were born in rural areas and worked hard in Suzhou.

Liang knows that Li is married and has a family and children.

But she doesn't care about this. She believes that Li will divorce his wife and then marry her.

Li also promised Liang many times that he would break up with his wife and marry her.

They often travel, travel, date and even live together.

  A forbearing original match

Xie is Li's wife. She discovered the fact that her husband was cheating in 2014.

She was sad and angry, but she didn't choose to divorce.

She considered that she had three children, the youngest of whom was only over one year old. She is worried that she can't support her children by herself, and she is also worried about her parents' face, for fear of being looked down upon.

She thinks that as long as her husband can still give her money and go home, she can tolerate his infidelity.

Xie took an attitude of turning a blind eye to her husband's infidelity.

Even if Li brought Liang back to the home where they lived, and even took Xiao San back for the New Year, she never made trouble.

She thought that her forbearance could win her husband's change of heart and save her shaky marriage.

  A forced marriage mistress

Liang is not willing to be a mistress, she wants to take metabolism and become Li's legal wife.

She constantly forced Li and Xie to divorce, and even took the initiative to find the door to confront Xie.

She doesn't admit that she is a third party. She insists that Li loves her, not Xie.

She thinks that Xie is an unattractive, incompetent and uneducated rural woman who is not worthy to be Li's wife.

Liang made all kinds of harassment and intimidation to Xie, and even called Xie's parents and relatives, saying that their daughter was a cuckold and asked them to persuade Xie to divorce.

Liang also used intimate photos and videos of himself and Li to stimulate Xie and let her know how low she is in Li's heart.

  A betrayed love rat.

Li is a playboy love rat. He wants to enjoy the warmth of his family and the excitement outside.

He told Liang that he would divorce Xie, but he never really took action.

He told Xie that he would break off relations with Liang, but he didn't really do it.

He has been playing with women's feelings on both sides, taking advantage of the money and joy that women bring him.

Li was not satisfied with having a junior three, but he actually found a junior four.

This junior four is a new employee in his clothing factory, younger and more beautiful than Liang.

Li soon abandoned Liang and turned to pursue junior four. He and Xiao Si often chat, date, travel and spend holidays. He loves and dotes on the fourth grade more.

It is under this complicated relationship that Liang can't stand Li cheating on his feelings, delaying divorce and marrying himself, and finding a "junior four" who is younger and more beautiful than himself.

So I rushed to the front of Li with a knife, thinking about killing Li and then ending my life.

But in the end, he lost his most precious life, which was not worth the loss.

  Legal analysis

This case involves several legal issues:

  1. Does Li constitute a crime of bigamy?

According to the provisions of Article of the Criminal Law, a person who marries another person with a spouse, or who marries another person knowing that he has a spouse, constitutes bigamy and is sentenced to fixed-term imprisonment of not more than two years or criminal detention.

In this case, although Li had an improper relationship with Liang and promised to marry her, he didn't really register with Liang.

Therefore, Li did not constitute bigamy. However, his behavior has seriously violated the provisions of the marriage law, infringed on Xie's legitimate rights and interests, and damaged social public order and good customs.

  2. Does Liang constitute a crime of intentional injury?

According to the provisions of the Criminal Law, intentional injury to another person's body constitutes the crime of intentional injury and is punishable by fixed-term imprisonment of not more than three years, criminal detention or public surveillance.

If the circumstances are relatively minor, they shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance. If the circumstances are serious, they shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years. If the circumstances are especially serious, they shall be sentenced to fixed-term imprisonment of not less than 10 years, life imprisonment or death.

In this case, Liang found Xiao Si because she couldn't stand Li's betrayal, and stabbed Li in front of Xie. Her behavior has obviously gone beyond the scope of self-defense and emergency avoidance, and it belongs to intentional injury to others' bodies.

According to the location and degree of Li's injury and the situation on the spot, it can be concluded that Liang's criminal circumstances are serious.

Therefore, Liang should bear the criminal responsibility of intentional injury.

  3. Does Xie have the right to ask Li to compensate for the loss?

According to the provisions of the Marriage Law, if one of the spouses has one of the following circumstances, the other spouse shall be given living expenses, medical expenses, alimony, alimony or spiritual damages: (1) committing domestic violence or abusing or abandoning family members; (two) bigamy or cohabitation with others; (three) there are other acts that damage the feelings of husband and wife.

In this case, Li obviously belongs to cohabitation with others and has other behaviors that damage the feelings of husband and wife.

He not only betrayed Xie, but also brought Liang home, even to his hometown for the New Year. His behavior caused serious mental injury and economic loss to Xie.

Therefore, Xie has the right to ask Li to compensate her for living expenses, medical expenses, alimony, alimony or mental damages. The specific amount of compensation should be determined according to the actual situation of both parties and the judgment of the court.

  4. Is Liang's death a suicide?

In this case, after stabbing Li, Liang stabbed his neck with the knife in his hand.

She died on the spot, leaving no trace of asking for help or struggling.

The police found a suicide note in her mobile phone case, which said that her death had nothing to do with others. She committed suicide. The police also found a notebook and paper for writing a suicide note in her home, confirming that the suicide note was written by herself. The police also seized the monitoring of her buying a knife, confirming that she bought the knife premeditated.

Based on the above evidence, it can be concluded that Liang's death was suicide, not homicide.

Why did Liang commit suicide? According to her suicide note and the situation at the scene, it can be inferred that she found Xiaosi because she could not accept Li's betrayal and humiliated her in front of Xie.

She felt that she had lost her love and dignity, and had no courage and meaning to live. She wants to punish Li with her own death, and also wants to end her pain with her own death.

Marriage is not a joke, and cheating is not a joke. If a person does not cherish his marriage, does not respect his spouse, and plays with others' feelings irresponsibly, it will eventually bring irreparable harm and consequences to himself and others.

If a person doesn't respect himself, cherish himself and fall into an improper relationship without distinguishing right from wrong, he will eventually lose the respect and trust of himself and others.

We should cherish the happiness we have, safeguard our due rights and abide by the laws we should respect. We should use reason and justice to guide our behavior, not emotion and desire to dominate our behavior. We should create value with life, not end it with death.
